Seven checks before changing your property structure
A practical checklist to discuss with your own adviser.

BEFORE A DECISION
Start with clear answers.
Your current structure requires individual review.
A general website cannot determine whether it needs changing.
What is registered today?
Identify the landowner, the building owner and any registered right.
Check the actual documents, not only the sales description.
What is the purpose of a change?
Define the outcome you need: personal use, rental management, succession or sale.
Compare the proposed structure with your existing position.
Where does the purchase money go?
Request a written breakdown of the seller, the buyer, purchase proceeds, funding and service fees.
An existing-owner transaction is not the same as a first purchase.
What is the full cost?
Separate one-time and annual charges, government costs, legal advice, management and exit costs.
Ask which amounts are estimates.
What if the landowner faces difficulties?
Have independent counsel examine the registered right, encumbrances and remedies if the land is sold, a dispute arises or the landowner faces insolvency.
How can I leave the arrangement?
Clarify transfer procedures, remaining term and fees.
The ability to transfer a right is different from having a buyer ready to purchase it.
What happens at the end of the term?
Check the term, the position of the building and the consequences of expiry.
Do not base the decision on an assumed renewal.
